If I buy a new toaster and it doesn't work I expect the merchant to replace it or to refund my money. Warantee statements usually specify the remedy and the time limit.

In a company to company relationship, the producer's management should have a policy to govern that situation, or else there should be an understanding between the producer's sales department and the consumer's purchasing department.

In general, I think that a producer should stand behind the product unless there is an up-front understanding to the contrary.
